This Fair Usage Policy ("Policy") is issued by Akash Sinha, proprietor of Averon Labs, trading as Brumo ("Brumo", "we", "us", "our")
Effective date: 10 September 2026 | Last updated: 15 September 2026
1.Usage Limits
The Services include a monthly limit on the number of automated replies and direct messages ("Automated Sends") that may be sent through the Services.
The applicable limit is the limit displayed on the Brumo pricing page, dashboard, or stated in your order confirmation, as applicable.
1.1 Free Plan
The Free Plan includes a fixed limit of 1,000 Automated Sends per monthly usage cycle, unless a different limit is displayed in the Brumo dashboard or otherwise communicated by Brumo.
The applicable Free Plan limit is displayed in the dashboard and resets at the beginning of each monthly usage cycle. Unused Automated Sends do not carry over to the next cycle.
Automated Sends reset at the start of each monthly billing cycle and do not carry over to the next cycle unless expressly stated otherwise.
1.2 Reaching the Limit
If you reach your plan's monthly Automated Send limit before the end of the applicable usage cycle, further Automated Sends will be paused until the next cycle begins.
We may notify you as you approach your applicable usage limit.
Brumo may change usage limits prospectively in accordance with the Terms & Conditions and applicable subscription terms.
2.Prohibited and Abusive Use
Regardless of your plan's usage limits, you may not use the Services to:
- send spam or unsolicited bulk messages that go beyond genuine engagement with End Users who have commented on, replied to a story of, or messaged your connected Instagram account;
- use the Services to send messages to persons who have not engaged with the relevant Instagram account in a manner permitted by the Services and applicable Meta or Instagram policies;
- resell, sub-license, rent, or otherwise make the Services available to any third party without Brumo's prior written consent;
- use the Services in any manner that violates Meta's or Instagram's platform policies, terms of service, or applicable API usage rules; or
- attempt to circumvent, disable, or interfere with any usage limit, rate limit, access control, or security measure applied to the Services.
Nothing in this Policy permits a use that is prohibited by applicable law or by Meta's or Instagram's applicable terms, policies, or technical restrictions.
3.Enforcement
Where we identify clear abuse of the Services — including spam, unsolicited bulk messaging, unauthorised resale or sub-licensing, or attempts to circumvent usage or security controls — we may immediately suspend the relevant account, automation, or functionality, without prior notice, where reasonably necessary to protect the Services, other customers, End Users, or the security and integrity of the Services.
We will inform you of the suspension and the reason for it as soon as reasonably practicable, subject to legal, security, or other legitimate restrictions on disclosure.
You may contact us at support@brumo.io to seek reinstatement. We will consider requests on a case-by-case basis and may require you to remedy the underlying issue before restoring access.
Suspension under this Policy does not entitle you to a refund except as, and to the extent, provided under the Refund & Cancellation Policy.
4.Monitoring and Use of End User Data
Brumo may monitor and process usage information, including Automated Send volumes and, where reasonably necessary, message content associated with the Services, solely to the extent necessary to:
- provide and maintain the Services;
- detect, prevent, investigate, and address spam, abuse, fraud, security incidents, or violations of this Policy;
- enforce the Terms & Conditions and other contractual terms applicable to the Services;
- comply with applicable law, lawful requests, and regulatory requirements; and
- protect the security, integrity, and availability of the Services.
Where Brumo processes personal data relating to persons who comment on, reply to, or message a creator's connected Instagram account ("End User Data") on behalf of the creator, Brumo processes that End User Data as the creator's Data Processor, and the creator remains the Data Fiduciary, to the extent provided in the applicable Data Processing Agreement.
Brumo will not use End User Data for independent advertising, profiling, sale, or other purposes unrelated to providing, securing, or enforcing the Services, except where otherwise expressly permitted by applicable law and the applicable contractual arrangements.
Brumo may separately process personal data relating to its own customers and users in accordance with its Privacy Policy. Nothing in this section changes Brumo's obligations regarding its own user account data.
The monitoring described in this section does not give Brumo a right to use End User Data for purposes unrelated to those stated above.
5.Changes to this Policy
We may update this Policy from time to time, including to reflect changes to plan limits, the Services, applicable law, or Meta's platform policies.
Where required by the Terms & Conditions or applicable law, we will provide notice of material changes.
Continued use of the Services after an updated Policy becomes effective constitutes acceptance of the revised Policy to the extent permitted by applicable law.
6.Governing Law
This Policy is governed by the same governing law and jurisdiction as the Terms & Conditions.
